These terms and conditions describe the general requirement for The Walk Away Plan™ operated by Crisis Management, LLC (hereafter “Crisis Management) and its WalkAwayPlan.com division. 1. Acceptance of Terms By accepting Crisis Management’s Terms and Conditions electronically or in writing, and / or by using Crisis Management’s services, including but not limited to, submission of the username and password to access the authorization form, payment or authorization of payment, you (Client) agree to be bound by the following terms and conditions. Client also agrees that Client’s electronic acceptance of these Terms and Conditions shall have the same force and effect as if Client had agreed to these Terms and Conditions in writing. 2. Description of Service Crisis Management is a service company that forwards information deemed relevant to any and all entities that may require client’s information, and by providing said information helps each Client understand what options and strategies are most likely, reasonable and favorable to each Client (the “Plan”). In no circumstance will Crisis Management intentionally or purposely inform or instruct Client on any action that is illegal or unethical as determined by Crisis Management. Crisis Management’s staff are not attorneys and their information and answers are in no way to be deemed legal advice. Client agrees to hold Crisis Management, its staff, management and affiliates completely harmless for damages that Client may incur as a result of acting upon the information provided by Crisis Management. Since each client’s situation is different the Plan we provide will be tailored to you as will the information we provide. Here are some of the things that Client may receive: a) A toll free number to speak with analysts and counselors that will help answer questions you have regarding your mortgage crisis. b) Information that could help clarify the laws in your area, debt collection rules and regulations. c) Customized letters to real estate agents, attorneys, or banks that will help make sure your rights are respected. 3. Using the Service; Fees You represent that all account information you provide to us in connection with your use of the service is related to a credit card or bank account in your name, and that all information you provide is completely true and accurate. Our staff will commit to spending a minimum of two hours working on your situation and file. For each use of our service a fee of $695 will be charged. The 100% Money Back Guarantee only applies to the initial fee and is deemed satisfied if any subsequent service is requested and/or additional payment is made. 4. Refunds If the Client’s Plan is not communicated to client verbally, by fax, by mail or by email within seven business days, you may receive a refund for 100% of our fee. All refunds will be in the form of a check or a credit back to the same card charged for the fee. The type of refund used will be solely up to Crisis Management, LLC. Refunds will be made within 90 days of receipt of your valid written request letter. Client Responsibilities a) Client must provide complete, true and accurate account and personal information. b) Client must submit in a timely manner all documentation / information requested by Crisis Management associates which may include mortgage statements, court documents and income information. c) Client must work diligently and cooperatively with all Crisis Management associates in regards to the service. 6. Warranty Disclaimer Our service is provided “as available” and “as is” without warranty as expressed or implied. 7. Limitation of Liability Except as otherwise expressly provided herein or required by law, in no event shall Crisis Management, LLC be liable for: a) Damages from or related to this service or agreement. b) Any incidental, indirect or consequential damages. 8. Termination / Modification We fully reserve the right to terminate and / or modify the service and all related aspects without notice in any manner we choose. 9.
